SEXUAL ASSAULT PREVENTION AND RESPONSE

Sexual assault is defined as intentional sexual contact, characterized by use of force, physical threat or abuse of authority or when the victim does not or cannot consent. Sexual assault includes rape, non consensual sodomy (oral or anal sex), indecent assault (unwanted, inappropriate sexual contact or fondling), or attempts to commit these acts. Sexual assault can occur without regard to gender or spousal relationship or age of victim.

Spousal sexual assault is considered Domestic Violence and will be referred to the local Family Advocacy Program.

Consent shall not be deemed or construed to mean the failure by the victim to offer physical resistance. Consent is not given when a person uses force, threat of force, coercion or when the victim is asleep, incapacitated, or unconscious.

Persons eligible for SAPR services include: Active duty personnel, DoD civilian employees and contractors, and the dependents of those previously noted who are 18 years and older. Reports of spousal sexual assault and sexual assault of minors will be referred to the local Family Advocacy Program.

SAPR personnel include Sexual Assault Response Coordinators (SARCs) and Uniformed or civilian Victim Advocates (UVA/VA). UVA/VAs are the first responders, and SARCs are the program managers for their respective commands.

Active duty personnel may choose to have a Uniformed Victim Advocate (UVA) or a civilian Victim Advocate (VA). Contact information for UVAs can be found in the common areas of your command and barracks. Civilian VAs can be reached at 645-HOPE (4673). The SARC for any active duty victim of sexual assault will be their Major Subordinate Command SARC.

Non-active duty personnel who qualify for SAPR services (i.e. adult depends and civilians) are eligible to receive first responder services from civilian VAs who can be reached at 645-HOPE (4673). The Installation SARC will serve as the SARC for non-active duty personnel.

Reporting Options: Restricted and Unrestricted

The restricted reporting option allows those who have been sexually assaulted to confidentially disclose the assault to certain individuals (SARC, UVA/VA, and healthcare personnel) and receive medical and counseling treatment without triggering an official investigation. Victims’ information will not be provided to law enforcement or the command unless an exception applies. Exceptions to confidentiality include:

1. When the victim authorizes the disclosure.

2. If the disclosure is necessary to prevent or lessen an imminent threat (i.e. harm to self or others).

3. For Disability or Medical Evaluation Boards.

4. SARC/UVA/VA/Healthcare personnel may exchange need to know information for the purpose of supervision or victim services.

5. If ordered by military or civilian courts when ordered.

Service members and their dependents (18 years or older) are eligible to file a restricted report. Only a SARC, UVA/VA, or healthcare provider can accept a restricted report of sexual assault.

Dependents younger than 18 years of age and those who have been assaulted by their spouse are referred to the local Family Advocacy Program where available.

Those electing the unrestricted reporting option can receive a forensic medical exam, medical care, counseling, a law enforcement investigation, and the command is notified of the report. Any of the following personnel can accept an unrestricted report of sexual assault: SARC, UVA/VA, healthcare personnel, chain of command, law enforcement or legal personnel. Once your commander is aware of the incident, he/she will take steps to separate you from the offender, and if appropriate, issue a Military Protective Order.

-The right to be treated with fairness and with respect for your dignity and privacy;
-The right to confer with an attorney (Legal Services: Bldg 437 Camp Foster 645-3065)
-The right to be reasonably protected from the accused offender;
-The right to be notified of court proceedings;
-The right to be present at all public court proceedings related to the offense, unless the court determines that your testimony would be materially affected if you as the victim heard other testimony at trial;
-The right to confer with the attorney for the government in the case;
-The right to available restitution;
-The right to information about the conviction, sentencing, imprisonment, and release of the offender.
